Privacy Statement

The website https://www.used.wackerneuson.com and the used machine portal integrated therein (hereinafter jointly referred to as the "Global Sales Stock System" or GSSS) are operated by Wacker Neuson SE, Preußenstraße 41, 80809 Munich, Germany (hereinafter referred to as "WN" or "we"). WN attaches great importance to the protection of your personal data and collects, processes, and uses your personal data exclusively in accordance with the principles described below and in compliance with the applicable data protection laws.

A. Your personal data

Personal data is all information that refers to an identified or identifiable natural person. This includes questions and comments to the seller, company or last name, e-mail address, or telephone number, selection of the preferred communication channel and the country according to your selection.

B. Processing of personal data

I. Nature and extent of processing

WN processes your personal data exclusively to the extent described below. We use your personal data in order to fulfill and execute the terms of use with you and to provide you with our services (Art. 6 (1) lit. b GDPR) or to fulfill our legal obligations (Art. 6 (1) lit. c GDPR).

II. Wacker Neuson GSSS customer account

In order to use our GSSS, it is necessary to set up a personal customer account (hereinafter referred to as "customer account"). In your customer account, you will receive a choice of used machines including the corresponding machine data (e.g. serial or material number, year of construction, mileage, used price, etc.). You can easily contact the assigned seller of the machine and, for example, arrange an on-site visit.

You will receive a username and an initial password for setting up your personal customer account. As a rule, the username corresponds to the personal e-mail address you have given us. After the first login, you will be asked to change your initial password to a password of your choice. You can change your password at any time for the future. We can also update your data if you wish.

Your customer account will remain as long as you do not delete it. You can have your account deleted at any time and with effect into the future at the following e-mail address or by letter to the above mentioned controller: info-used@wackerneuson.com

III. Contact Form

You can use the contact form provided in the GSSS to contact the seller of the used machine directly and arrange an on-site visit, for example. WN collects the information provided by you via the contact form (questions and comments to the seller, company / surname, e-mail address or telephone number, choice of preferred communication channel, country) exclusively for transmission to the seller deposited in the GSSS and only for processing your request.

IV. Transmission to logistics providers

If you come to an agreement with the seller of the used machine, he may also transmit the information you provide in the GSSS to external logistics providers. This is to serve the fulfillment of the purchasing contract concluded between you and the seller pursuant to Art. 6 (1) lit b. GDPR. In this case, the seller of the machine acts as a controller within the meaning of the GDPR. If you do not wish such transmission, please inform the seller of the used machine accordingly.

V. Processor

Wacker Neuson SE has appointed a processor to operate the platform and concluded a contract pursuant to Art. 28 GDPR. All companies appointed by Wacker Neuson SE are carefully selected and regularly inspected for compliance with data protection requirements and processing security. All employees are specially trained with regard to their data protection obligations and have signed a confidentiality agreement.

Mascus International B.V. was commissioned to operate the GSSS. Any inquiries you wish to make as a data subject should be addressed to the controller (see contact details at the beginning of this statement) or to the data protection officer (Section F of this statement). Processing will take place exclusively within the European Union.

VI. Server-Log-Dateien

The provider of the GSSS automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Type and version of browser
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data will not be merged with other data sources. The basis for data processing is Art. 6 (1) lit. f GDPR. Due to the obligations of the GDPR, we have a legitimate interest in operating the platform in such a way that it can meet the objectives of "integrity, confidentiality, and availability." The above data categories serve these purposes.

VII. Cookies

The GSSS uses so-called "cookies." Cookies are small text files and do not cause any damage to your terminal device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until an automatic deletion takes place by your web browser. In some cases, cookies from third-party companies can also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).

Cookies have various functions. Numerous cookies are technically necessary because certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to track user behavior or display advertisements. Technically necessary cookies (e.g. shopping cart cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in the storage of cookies for the technically error-free and optimized provision of our services.

Other cookies will only be stored with your consent on the basis of Art. 6 (1) lit. a GDPR. Your consent can be withdrawn at any time in the future. You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, accept cookies for certain cases or generally exclude them and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted. If cookies are used by third-party companies or for analysis purposes, we will inform you of this separately in the context of this data protection declaration and, if necessary, request your consent.

In addition to Google Analytics (see next section of this statement), the GSSS uses another cookie ("Mascus Plus"). This saves country-specific settings in order to enable you to operate the platform as conveniently as possible: Country, language, currency, measurement system, and units. In addition, the cookie records the last product you viewed on the GSSS. The cookie is stored on the basis of Art. 6 para. 1 lit. f GDPR.

VIII. Analysis Tools – Google Analytics

eTracker

The website operator uses services of etracker GmbH from Hamburg, Germany (www.etracker.com) to analyze usage data. We do not use cookies for web analysis by default. Insofar as we use analysis and optimization cookies, we obtain your explicit consent separately in advance. If this is the case and you give your consent, cookies will be used to enable statistical coverage analysis of this website, measurement of the success of our online marketing measures, and test procedures, e.g. to test and optimize different versions of our online offering or its components. Etracker cookies do not contain any information that enables identification of a user.

The data generated by etracker is processed and stored by etracker on behalf of the provider of this website exclusively in Germany and is therefore subject to the strict German and European data protection laws and standards. Etracker has been independently audited and certified in this respect and awarded the ePrivacyseal data protection seal of approval.

Data processing is carried out on the basis of the legal provisions of Art. 6 (1) lit. f (legitimate interest) of the German Data Protection Regulation (GDPR). Our concern in terms of the GDPR (legitimate interest) is the optimization of our online offer and our web presence. Since the privacy of our visitors is important to us, data that may allow a reference to an individual person, such as the IP address, login, or device identifiers, are anonymized or pseudonymized as soon as possible. No other use is made of the data, nor is it merged with other data or passed on to third parties.

You can object to the outlined data processing at any time by clicking on the slider. The objection has no disadvantageous consequences. If no slider is displayed, the data collection is already prevented by other blocking means.

GSSS uses Google Analytics, a web analysis service of Google Inc. ("Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses cookies, which allow an analysis of the use of the GSSS by you. The information generated by the cookie about your use of the GSSS is transferred to a Google server, where it is stored. IP anonymization has been activated in this GSSS so that the IP address of Google users within member states of the European Union or in other contracting states of the Agreement on the European Economic Area is shortened beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA where it will be shortened. On our behalf, Google will use this information to evaluate users' use of the GSSS, to compile reports on GSSS activities, and to provide GSSS operators with other services relating to GSSS use and internet usage. The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google. We have concluded a contract with Google for order data processing and fully implement the strict requirements of the supervisory authorities for the use of Google Analytics.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the GSSS. In addition, users can prevent Google from collecting the data generated by the cookie and related to their use of the GSSS (including your IP address) and Google from processing this data by downloading and installing the browser plug-in available under the following link. IX. Map Service – Google Maps

GSSS uses the Google Maps map service via an API. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland. To ensure the privacy of this website, Google Maps is disabled the first time you visit this website. A direct connection to Google's servers will only be established if you activate Google Maps yourself (consent according to Art. 6 para. 1 lit. a GDPR). This prevents your data from being transferred to Google the first time you enter the site. After activation, Google Maps will save your IP address. This is then usually transferred to a Google server in the USA and stored there. After Google Maps has been activated, the provider of this page has no influence on this data transfer. D. Withdrawal of Consent

E. Data Security

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as information you transmit. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

WN also uses technical and organizational security measures to protect the data provided to us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security measures are continuously improved in line with technological developments. Please note, however, that data security cannot be absolutely guaranteed when communicating via the Internet, especially when using e-mail, and that we recommend sending confidential information by post.
